General Terms and Conditions SIMA de VerhuurXpert
Rental Period:
At SIMA de VerhuurXpert, you have the following options:

A half day is a maximum of 4 hours, either from 8:30 to 12:30 or from 13:00 to 17:00.

A full day is a maximum of 24 hours, starting at the moment of delivery and ending 24 hours later. An exception applies to trailer rentals: a full day is from 8:30 to 18:00 (Monday to Friday), and on Saturday from 8:30 to 17:00.

An extra day follows the first day and begins at the end time of the first rental period, running for another 24 hours. This continues for each additional rental day.

A weekend starts on Saturday between 8:30 and 9:30 and ends on the following Monday between 8:30 and 9:30.

A week consists of 7 days, starting at the time of delivery and lasting 7 × 24 hours.
Delivery:
All rented tools and/or machines can be picked up during opening hours at our location at Industrieweg 24, Eindhoven.
Identification:
We require all customers to provide valid Dutch identification with a photo (EU passport, ID card, or driver’s license). We record the document number, address, phone number, and, if available, email address. In some cases, we may make a copy of the ID, which will be destroyed upon return of the equipment.
Deposit:
All items rented from SIMA de VerhuurXpert have significant value. Therefore, we always require a deposit from private customers and companies who do not have an account with us.
Cleaning and Repair:
We ensure that all items are clean and in good condition upon delivery. We expect the same condition upon return. Extra cleaning and/or repair costs will be charged if this is not the case.
Wear and Tear:
Consumable wear on accessories (e.g. diamond drills, blades, chisels, chains) may incur additional charges. This does not apply to all accessories—SIMA will always inform you. Damaged or unusable items after rental will also be charged.
Accessories:
Some accessories are available for rent, others only for purchase. Unused accessories can be returned.
Liability:
The renter is 100% liable and is NOT insured via SIMA de VerhuurXpert.
Fines and Citations:
All penalties, including handling fees (€25), during the rental period are the full responsibility of the renter/driver.

Article 1. General:
SIMA de VerhuurXpert is part of Dekla Outdoor. These terms apply to every reservation/rental agreement between SIMA and the renter.
Article 2. Reservation/Rental Agreement:
A reservation becomes binding upon signing the agreement. The renter tacitly agrees to the rental terms, which are available online and in the store.
Article 3. Rental Duration:
The rental period is defined in the agreement, starting from delivery (date and time) and ending at the pre-agreed moment. The rental continues on weekends and Dutch public holidays unless agreed otherwise.
Article 4. Delivery:
All rented tools and/or machines can be collected during opening hours at Industrieweg 24, Eindhoven.
Article 5. Deposit:

A deposit is required from all non-account customers. The amount is listed under "Rates" on the website and applies to one day’s rental. A higher deposit may apply for longer periods.

The deposit must be paid in advance, preferably by debit card.

At the end of the rental period, the final invoice includes rental fees, cleaning/repair/wear costs, consumed accessories, and other charges. This is offset against the deposit.
Article 6. Rental Rates:
All rates on the website and agreement include VAT. A final invoice can be provided detailing VAT and pre-/post-VAT totals.
Article 7. Use – Maintenance – Cleaning – Repairs:
The renter must maintain the rented items properly, use them as intended, and return them clean and in good condition. Issues must be reported within 24 hours. Repair and cleaning costs are at the renter’s expense.
Article 8. Loss – Theft – Fire:
The renter is fully liable for loss, theft, fire, or negligence. Preventative measures must be taken. In case of theft/loss, it must be reported to SIMA within 24 hours and to the police. The damage will be charged at the item's current value plus lost profit.
Article 9. Return:
Return must occur at the agreed time. Items are checked for condition and completeness. Used accessories are recorded. Late returns may result in double charges for the overdue period.
Article 10. Payment – Invoicing:

If a deposit was paid, the final invoice is settled against it.

Invoices must be paid within 14 days unless otherwise agreed.

Late payment incurs 5% interest per month.

All collection costs (admin/legal) are charged to the renter.

In case of default, SIMA may reclaim all rented items and charge related costs.
Article 11. Ownership:

All items remain property of SIMA. The renter may not sell, sublease, or transfer them.

The renter must notify SIMA immediately if third parties claim rights or if legal seizure occurs.

Costs/damages from failing to inform SIMA are charged to the renter. SIMA may terminate the agreement immediately.

SIMA reserves the right to reclaim rented items at any time.
Article 12. Liability:

SIMA is not liable for damage or accidents unless caused by gross negligence.

SIMA is not liable for business interruptions, delays, or consequential damages.

SIMA accepts no responsibility for losses due to equipment failure.

The renter is fully liable for trailers and scaffolding in case of damage, theft, fire, or negligence.
Article 13. Force Majeure:
Force majeure includes unforeseen circumstances beyond SIMA’s control such as supplier delays, war, riots, fire, natural disasters, strikes, roadblocks, government measures, etc. SIMA may cancel or postpone obligations without liability.
Article 14. Disputes – Applicable Law – Jurisdiction:

Dutch law applies.

Disputes will be handled by the court in SIMA’s district unless SIMA chooses another competent court.
